US hearing warns FBI, Facebook on facial recognition

Washington (AFP) July 18, 2012 - An Estonian national was sentenced Wednesday to seven years in prison for hacking schemes involving the theft or sale of more than 240,000 credit card numbers, officials said.

The Justice Department said Aleksandr Suvorov, 28, was sentenced by US District Judge Sandra Feuerstein in Central Islip, New York.

Suvorov, an accomplice to Albert Gonzalez, one of the most prolific identity thieves ever prosecuted by the US government, pleaded guilty in 2009 to wire fraud conspiracy for hacking into the restaurant chain Dave & Buster's database.

Some 80,000 credit card numbers were stolen in that scheme.

Suvorov also pleaded guilty in November 2011 to charges stemming from the sale of more than 160,000 stolen credit card numbers to an undercover agent with the US Secret Service.

He was ordered to pay $675,000 in restitution and to forfeit $300,000.

According to court documents, Suvorov, Albert Gonzalez and a third person set up a scheme to install a "packet sniffer" in the restaurant chain's database that sent credit card numbers to a co-conspirator in Ukraine.

They gained access to 11 Dave & Buster's restaurants and ultimately obtained data from 81,005 credit cards.

Gonzalez was sentenced in March 2010 to 20 years in prison for his role in the scheme, as well as hacks into a major payment processor and several retail networks.

The other co-conspirator was arrested in Turkey on related identity theft charges, and was sentenced there to 30 years in prison, according to the Justice Department.

In a separate incident in California, Suvorov and an accomplice conspired to sell more than 160,000 stolen credit card numbers to a buyer in San Diego who was an undercover agent. He was arrested in Germany and extradited.

"Mr. Suvorov participated in a scheme to sell thousands of credit card numbers stolen from unsuspecting consumers," said Assistant Attorney General Lanny Breuer.

"Computer hackers like Mr. Suvorov victimize businesses and individuals, posing a serious threat to their financial security. Today's sentence sends a clear message that cyber criminals operating abroad will suffer severe consequences for their crimes."



A US Senate hearing Wednesday highlighted concern over the growing use of facial recognition technologies, both for law enforcement use and in big social networks like Facebook.

Senator Al Franken, who chaired the judiciary subcommittee hearing, said the expansion of such biometric technologies poses concern over privacy and civil liberties.

Franken said that in law enforcement, the use of facial recognition "will catch criminals," but "could come at a high cost to our civil liberties" if police use the systems to target "innocent civilians" or political rallies.

He also expressed concern that facial recognition used by Facebook to "tag" or identify members could be abused by divulging information that its members do not want made public.

Representatives of the FBI and Facebook testified about their safeguards, and civil liberties advocates and others offered views on the new technology.

Franken said facial recognition "exists right here today" and that "our federal privacy laws are unprepared to deal with this technology."

"Law enforcement doesn't need a warrant to use this technology," Franken added.

On the commercial side, he said, "if a store wants to take a picture and generate a 'faceprint,' they can do it, and they might even be able to sell it to third parties."

Jerome Pender, an FBI deputy assistant director, said the federal law enforcement agency has a database of 12.8 million photos and plans to expand a pilot project to nationwide use by 2014.

But Pender said the agency "is committed to ensuring appropriate privacy protections are in place" for the system. That includes only allow law enforcement to search the data and that only "mugshots" of persons arrested would be included.

But Franken said he was unconvinced: "I'm concerned that it could be used to identify people marching around a courthouse or at a political rally."

Maneesha Mithal of the US Federal Trade Commission said meanwhile that the watchdog agency is studying how to regulate commercial use of facial recognition for firms like Facebook, where she said 2.5 billion photos are uploaded to each month.

She said one way facial recognition is being used in the private sector is for targeted advertising. For example, a digital kiosk can display an ad believed to be relevant to a person's age or gender after an image is scanned by face recognition technology.

Facebook's Rob Sherman said the social network "only uses a person's friends" to allow tagging and encrypts that data so third parties cannot use it.

But Franken criticized Facebook for making the use of the technology "opt out" so that it is used unless the member changes his profile to opt out.

"Facebook users upload 300 million photos to the site each day," he said.

"Faceprints can be happening without a person's consent or knowledge... I think this information is so sensitive I think it's the kind thing users should be able to opt themselves into."

One case evoked at the hearing was a Carnegie-Mellon University professor's study in which pictures were taken from students walking across campus and matched to photos on dating websites which were supposed to be anonymous, all using publicly available data.

Privacy groups said laws need to be updated to offer more protection.

"Businesses should never use facial recognitions techniques to obtain the actual identity of consumers without the consumer's actual knowledge and informed consent," said a statement submitted to the hearing by the Electronic Privacy Information Center.

"Consumers today enjoy enormous freedom and personal safety because they are able to interact with so many merchants, who are essentially strangers, without concern that they will be secretly tracked and profiled."

YouTube lets people blur faces in videos
San Francisco (AFP) July 18, 2012 - YouTube on Wednesday began letting people blur faces in videos they upload to the website, which has become a major platform for sharing clips of dramatic news events.

"Today we're launching face blurring -- a new tool that allows you to obscure faces within videos with the click of a button," said Amanda Conway, policy associate at the Google-owned video-sharing service.

"As citizens continue to play a critical role in supplying news and human rights footage from around the world, YouTube is committed to creating even better tools to help them."

Video editing options at YouTube were expanded to include a "Blur All Faces" button. People will get previews of videos with the blurred effects prior to deciding whether to publish them at YouTube.

"This is emerging technology, which means it sometimes has difficulty detecting faces depending on the angle, lighting, obstructions and video quality," Conway said.

"It's possible that certain faces or frames will not be blurred."

A Pew Research Center report this week indicated that news is rapidly becoming important as YouTube grows far beyond its roots as a stage for amateur videos ranging from silly backyard stunts to children and pets.

Certain events like last year's earthquake and tsunami in Japan highlighted that point, the study found, with 96 million views of disaster-related news over a one-week period in March 2011.

"YouTube is proud to be a destination where people worldwide come to share their stories, including activists," Conway said.

"We hope that the new technologies we're rolling out will facilitate the sharing of even more stories on our platform," she continued.

"Visual anonymity in video allows people to share personal footage more widely and to speak out when they otherwise may not."

YouTube made Google the top online venue for US online video viewing in June, attracting approximately 154.5 million visitors who watched just shy of 18.3 billion videos, according to industry tracker comScore.

According to the company's own statistics, more than 72 hours of video are uploaded to YouTube every minute. The site gets over four billion video views a day.
