US judge won't lift Samsung tablet ban

Taiwan's Foxconn to open new plant in Brazil
Taipei (AFP) Sept 19, 2012 - Taiwanese technology giant Foxconn said Wednesday it is set to invest $492 million to build a new facility in Sao Paulo, Brazil to produce smartphones, tablets and other electronic devices.

Foxconn said the factory is expected to start operation in 2014 and reach full capacity in 2016 with a workforce of 10,000 people.

Foxconn is the world's largest maker of computer components and assembles products for Apple, Sony and Nokia.

The company has been working in Brazil since 2003, and already operates four factories in Latin America's biggest economy.

Tax breaks offered by the Brazilian government as well as proximity to fast-growing local markets have made Brazil an attractive alternative for manufacturing operations to China, it said.

Foxconn employs about one million workers in China, roughly half of them based in its main facility in Shenzhen, which borders Hong Kong.

The company has come under the spotlight after suicides and labour unrest at its Chinese plants since 2010, which activists have blamed on tough working conditions.

A judge has refused to lift a ban on US sales of Samsung Galaxy Tab 10.1 tablet computers as legal brawling continued between the South Korean electronics titan and Apple.

US District Court Judge Lucy Koh cancelled a Thursday hearing at which Samsung and Apple were to duel over a ban put in place before the start of a trial that ended with a huge victory for the California company.

A jury declared on August 24 that Samsung should pay Apple $1.049 billion in damages for illegally copying iPhone and iPad features.

Apple has reportedly requested a hearing before Koh to argue that the amount should be tripled as allowed by law since jurors found Samsung "willfully" infringed on patents.

However, the jury agreed that Samsung did not abuse design patents that were the grounds for a temporary ban on Galaxy Tab 10.1 device imports that Koh put in place at Apple's behest in June.

Koh wrote in her ruling that she would grant Samsung's request if she could, but that she no longer has authority to make the call since the company appealed to a higher court to have the ban overturned.

"The sole basis for the June 26 preliminary injunction no longer exists," Koh said in a written decision. "The court at this time would dissolve the June 26 preliminary injunction if the court had jurisdiction."

She also noted that the jury verdict in her San Jose, California, courtroom didn't represent a "final ruling" in the case since it was being appealed.

Apple won more than $1 billion in a massive US court victory over Samsung on August 24, in one of the biggest patent cases in decades -- a verdict that could have huge market repercussions.

Samsung reacted by saying the verdict was "a loss" for consumers and that Apple had "manipulated" the patent system.

The South Korean firm also said the verdict was "not the final word" in this case or other similar battles around the world.

The decision appeared to be an overwhelming victory for Apple, but it was not immediately clear whether it would halt sales of Samsung devices or affect newer models released since the case was filed.

The jury decided the case with over 700 separate claims in less than three days of deliberations.

The verdict affects a range of Samsung products including some of its popular Galaxy smartphones and its Galaxy tablet -- devices alleged to have been copied from the iPhone and iPad.

Samsung had steadfastly denied the charges by Apple, claiming it developed its devices independently. It unsuccessfully argued that Apple infringed on its wireless patents.

HTC launches Windows-powered smartphones
Washington (AFP) Sept 19, 2012 - Taiwan's HTC unveiled its first smartphones powered by Microsoft's Windows on Wednesday, in a boost for the US software giant's efforts to break into a market dominated by Apple and Google.

HTC and Microsoft previewed the 8X and 8S handsets in New York, boasting that they feature "iconic design," studio-quality sound and "incredible camera capabilities."

The companies said the HTC devices would be available from November through more than 150 carriers in at least 50 countries

"We've been inspired by Windows Phone 8 to create new smartphones that give the platform the iconic design and personality it deserves," said Peter Chou, HTC's chief executive.

"Windows Phone has clearly emerged as one of the top mobile ecosystems and is competitive against any other smartphone platform in the world."

Among the carriers participating are US-based AT&T, T-Mobile and Verizon Wireless, Europe's Orange, O2 Telefonica, MTS, Three UK, T-Mobile and Vodafone and Asia-Pacific carriers Chunghwa Telecom, Optus, Singapore Telecommunications, Smartone, Telstra and Vodafone Australia.

The news comes two weeks after Finland-based Nokia unveiled its smartphones powered by Windows Phone 8, Microsoft's upgraded mobile operating system that aims to compete with Apple's iOS used on the iPhone and a multitude of Google Android handsets.

"Pairing HTC's beautiful new Windows Phone 8X and 8S with our brand is a big milestone for both companies," said Steve Ballmer, Microsoft chief executive.

"Together we are offering customers a clear choice and a truly unique experience. I'm thrilled to take our longstanding partnership to the next level."

The HTC devices have a design based on the Windows Phone Live Tiles and will come in colors including "California blue," graphite black, flame red, and "limelight yellow."

HTC will use and ultra-wide angle front-facing camera that allows up to four people and more to be captured at once, which also allows for high-definition video capture.

It said its Beats Audio "provides authentic, studio-quality sound that delivers the spirit of the original recording."

The phones will have displays of at least four inches, matching or exceeding that of the new iPhone 5, and will use the newest version of Corning's lightweight Gorilla Glass.
